当前，我国经济转向高质量发展阶段的巨大潜力和增长空间使得对矿产资源的需求将持续增长，而矿产资源制度的时代缺陷日益显现，表现出与实践需求在一定程度上“脱节”，主要表现为既有矿产资源制度重经济价值实现，轻生态环境保护，矿产资源经济利益分配制度未全面覆盖利益主体，缺乏保障资源安全的制度关照。新时代，矿产资源法应当以习近平新时代中国特色社会主义思想为指导，按照建设现代化经济体系与生态文明的内在要求，从矿产资源保护与利益分配的双重视角出发，重构矿产资源法以符合新时代中国式现代化建设的需求。
